Petitioner seeks bail in Ganga Bridge P.S. Case No. 116 of 2011 registered for the offence punishable under Sections 376/34 of the Indian Penal Code.

Allegation against the petitioner is to have committed rape upon the informant along with F.I.R. named accused. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 23.04.2018.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.3603 of 2019(5) dt.27-02-2019 2/2 and nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
