The petitioner is languishing in custody since 25.02.2015 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Informant's twenty one thousand rupees, mobile and several documents were robbed leading to the registration of the FIR against four unknown. The name of the petitioner sprang up on the confession of co-accused Chhotu Poddar.

Statement has been made in para 10 of the petition that neither there is any recovery from the petitioner nor the petitioner has been put on TIP.

No.22796 of 2015 (2) dt.13-07-2015 2/2 Considering the fact that the petitioner has not been put on TIP and the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Muffasil P.S. Case No. 09 of 2014.

Since the petitioner is involved in six other cases of similar nature, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or gets substantially involved in some serious nature of offence.
