JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The alleged occurrence is said to have taken place in the year 2003 but petitioner could be remanded in this case on 30.07.2015. There is specific allegation against the petitioner that he opened fire on the deceased.

Therefore, taking into consideration the nature of allegation levelled against the petitioner as well as his previous conduct, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No.

Patna High Court Cr.Misc. No.13848 of 2016 (2) dt.04-04-2016 2/2 264 of 2015 arising out of Salkhua P.S. Case No. 103 of 2003 pending in the court of Additional Sessions Judge-II, Saharsa stands rejected.
