The petitioner apprehends his arrest in Biraul P.S. Case No. 428 of 2016, registered for the offences punishable under Sections 341, 323, 353, 504 and 506 of the Indian Penal Code.
Prosecution case in brief is that on the alleged date and time of occurrence this petitioner came to the Sub-Post Office, Biraul and asked the informant for withdrawal of money from another account for which informant refused, then this petitioner abused and assaulted him.
It is submitted that petitioner has been falsely implicated in this case and has committed no offence. As a matter of fact, petitioner along with others were raising voice
Patna High Court CR. MISC. No.4525 of 2022(2) dt.28-07-2022 2/2 against the conduct of informant and in retaliation this false case has been lodged by the informant. The police after investigation found the case false against the petitioner. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Biraul, Darbhanga in connection with Biraul P.S. Case No. 428 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
