In this case, the petitioner is seeking anticipatory bail in connection with Dulhin Bazar P.S. Case No.144 of 2018, registered for the offence punishable under Sections 420, 468, 34 of the Indian Penal Code.

Allegation has been made that the petitioner has collected the electric bills from different consumers with the assurance that he will deposit the money to the electricity office, but instead of depositing the same, he pocketed the money. Learned counsel for the petitioner submits that he will handover the money to all the consumers along with

Patna High Court Cr.Misc. No.5870 of 2019(2) dt.04-02-2019 2/2 interest whatever it has been paid by them and will file receipts in the court below.

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on provisional bail in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate - III, Danapur (Patna), in connection with Dulhin Bazar P. S. Case No. 144 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. If the petitioner will return back the money along with the interest to the concerned consumer and will submit the receipt of the same to the court below, then after proper verification of the same, provisional bail of the petitioner will made absolute.
