The petitioner apprehends arrest in a case registered for the offence punishable under sections 392, 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Manish Kumar. There is no description of the motor cycle of the informant in the FIR which is alleged to have been stolen. The motorcycle which has been recovered from petitioner was purchased from Md. Masium. In support, he has also annexed sale letter and registration certificate. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.4477 of 2022(3) dt.06-09-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali (Belsar O.P) Police Station Case No. 02/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
