JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Patahi P.S. Case No. 211 of 2015, registered under Section 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26 / 35 of the Arms Act.

The accusation is that on secret information, petitioner and three others were apprehended by the Police. On search a loaded country made pistol and a mobile phone was recovered from the possession of co-accused Amrendra Pandey, two cartridges and a mobile phone were recovered from the possession of accused Chandan Singh, two cartridges were recovered from the possession of accused

Patna High Court Cr.Misc. No.13736 of 2016 (2) dt.22-04-2016 2/2 Pradeep Kumar and five mobile phones and a digger were recovered from the possession accused Anand Mohan Singh. Learned counsel for the petitioner submits that no incriminating material has been recovered from the possession of the petitioner. Further submission is that petitioner has falsely been implicated in this case merely on suspicion. The petitioner is accused in Madhuban P.S. Case No. 156 of 2013, but he is on bail in the said case. The petitioner is in custody since 31.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 8th Addl. Chief Judicial Magistrate, Motihari East Champaran in connection with Patahi P.S. Case No. 211 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
