The petitioner seeks bail in Bodh Gaya P.S. Case No. 68/2013, instituted for offences under Section(s) 147, 148, 149, 341, 342, 323, 324, 307, 302, 333, 337, 338, 222, 224, 225, 353, 120(b) and 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has transpired during investigation merely on suspicion.

It is alleged in the written report that on the date of occurrence this petitioner along with named accused persons and 200 to 250 unknown persons variously armed with Lathi,

Patna High Court Cr.Misc. No.6095 of 2019(2) dt.04-02-2019 2/2 Danda, Garasa, Sword, Pasuli and other weapons attacked on police party due to which one police Jawan died. Some arms and ammunitions were also found missing from the possession of dead Jawan.

The other accused persons have already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 34129/2018 dated 14.08.2018.

Petitioner is in custody since 05.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 68/2013, subject to the conditions that both the bailors shall be the close relative of the petitioner.
