1. Though the present writ petition was filed for removing the encroachment from the land, appertaining to Khata No.212, Khesra No.687/433, situated at Shahkund, Block-Bhagalpur, but the respondents have filed a counter affidavit, wherein they have stated that an encroachment case bearing Encroachment Case No.06 of 2023-24 has already been initiated by the Circle Officer, Shahkund, Bhagalpur and the same would definitely be taken to its logical conclusion, within a stipulated time frame, as is fixed by this Court.
2. Having regard to the stand taken by the respondents in the present case, I deem it fit and proper to direct the Circle
Patna High Court CWJC No.1798 of 2024(2) dt.02-05-2024 2/2 Officer, Shahkund, District-Bhagalpur to conclude the proceedings of the aforesaid encroachment case by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt/production of a copy of this order.
3. The writ petition stands disposed off on the aforesaid terms.
