The petitioner is languishing in custody since 21.01.2014 in a case registered for the offences punishable under Sections 395/412 of the Indian Penal Code.

The accusation is of committing dacoity of 24 batteries from the Airtel mobile service provider. Subsequently 24 batteries were recovered from a pick-up van from which the petitioner was apprehended and from the possession of petitioner one mobile was recovered, the petitioner claims the same of his own.

It is submitted by learned counsel for the petitioner that the recovery from the pick-up van does not suggest that the recovery has been made from the petitioner and the driver

Patna High Court Cr.Misc. No.23642 of 2014 (05) dt.05-01-2015 2/2 of the pick-up van has been granted bail vide Cr. Misc. No. 22518 of 2014. Though, the petitioner has been made accused in one other case apart from present one being Masaurhi P.S. Case No. 29 of 2014.

Considering the fact that the co-accused has been granted bail, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No. 28 of 2014.
