JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 457, 380, 511 and 427 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of Arms Act.

The prosecution story, in brief, is that on 24.03.2014 at about 2.00 a.m. (night) the informant and others were on patrolling duty and during such period the informant have crossed near the Lakhy Bagh S.B.I. ATM and have seen six and seven persons had entered into the S.B.I. ATM and they were cutting ATM Machine through Gas cutter on that the informant and others chased to them in which of them have been caught and others were succeeded in fleeing away and the apprehended person

Patna High Court Cr.Misc. No.23942 of 2015 (2) dt.06-07-2015 disclosed his name Ravi Mistry.

It has been submitted on behalf of the petitioner that the name of the petitioner has come on the basis of confessional statement of o- accused. Further it has been submitted that no incriminating article has been recovered from the possession of the petitioner. It is also submitted that the petitioner is in custody since 19.02.2015. Learned counsel for the petitioner has further submitted that the petitioner may be release on bail after completion of six months of custody.

Considering the facts aforesaid, the above named petitioner is directed to be released on bail, after completion of six months in custody from 19.02.2015, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Gaya, in Muffasil P.S.,Case no. 155 of 2014.
