====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 03.04.2018 in a case for the offence registered under Sections 302 and 201/34 of the IPC.

The prosecution story, in brief, is that the informant Bimla Devi, who is mother of the deceased, on 02.04.2018 at about 11.00 A.M. got information that her daughter has been killed by her husband Munna Singh, father-in-law Sheo Shankar Singh and mother-in-law Sumitra Devi and on this information, the informant alongwith her husband and her family members went at the Sasural of her deceased daughter where they saw that the door of the accused persons are closed and on enquiry they came to know that the accused persons have killed her daughter by assaulting and they have also disposed of the dead

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Neither there is any eye witness to the alleged occurrence nor there is any substantive evidence to suggest the implication of the petitioner in the present case. The petitioner's wife was suffering from illness and in course of treatment she died.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IVth, Saran at Chapra, in connection with Panapur P.S. Case No. 47 of 2018.
