The petitioner is in custody in connection with Special Case No. 9259 of 2018 arising out of Paliganj P.S. Case No. 324 of 2018 registered for the offence under Sections 279, 337, 338, 304 (A) of the Indian Penal Code and Section 37 (b) of Bihar Prohibition & Excise Act.

Learned Counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. Referring to the prosecution case he submits that allegation against this petitioner is that he was plying bike in drunken condition and met an accident in which victim died during the treatment. Considering the totality of the fact situation including the fact that petitioner is in custody since 02.10.2018 and the investigation in all respects is now complete, the Court is
