JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-01-2022 Heard Mr. Ravish Mishra, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Patepur P.S. Case No. 147 of 2020 instituted for the offence under Sections 30(a)/41(1) of the Bihar Prohibition and Excise Act, 2018.
477 litres of liquor is said to have been recovered from a pick-up van which belongs to the petitioner. There has also been a recovery of 1373.4 litres of liquor from a truck in the same transaction. Learned counsel for the petitioner has submitted that he had lent his vehicle viz. the pick-up van for being plied commercially to one Vishwanath Sahni who has played truant. The petitioner did not have
Patna High Court CR. MISC. No.15313 of 2021(2) dt.04-01-2022 2/2 an idea that his vehicle would be used by aforesaid Vishwanath Sahni for such unauthorized purpose. The petitioner has clean antecedents.
Considering these facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Patepur P.S. Case No. 147 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
