The petitioner seeks bail in a case registered for the offence punishable under Sections 372, 373, 366, 368, 327 & 120 B of the Indian Penal Code and Section 4/5 of the Immoral Traffic Prevention Act, 1956.

The prosecution case, in brief, is that 12 persons have been apprehended while they were near a car on the allegation that they were indulging in immoral traffic of girls. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case merely on suspicion. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against

As a matter of fact, the petitioner was standing near the spot and watching the crowd from where he has been arrested on suspicion. Similarly situated co-accused Asha Devi @ Munni Devi and Indra Raj and others have been granted bail by a coordinate Bench of this Court vide order dated 28.06.2021 and 11.02.2021 passed in Cr. Misc. No.7317 of 2021 and Cr. Misc. No.39405 of 2020 respectively. The petitioner has no criminal antecedent and has been languishing in custody since 09.09.2020.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kudra P.S.
