The petitioner seeks regular bail in connection with Alauli P.S. Case No. 409 of 2018, registered for the offence punishable under Sections 25(1-B)a, 26 of the Arms Act and Section 37(B) of the Bihar Excise Prohibition and Amendment Act, 2018.
The allegation is regarding the informant having recovered one country made pistol from the possession of the petitioner along with one cartridge and thereafter, he had called the police and handed over the said pistol and cartridge to the police along with the petitioner, who was in a drunken condition.

No.2606 of 2019(2) dt.21-01-2019 2/2 The learned counsel for the petitioner submits that in fact, no recovery has been made from the conscious possession of the petitioner, the petitioner is having a clean antecedent and he is languishing in custody since 17.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Incharge Special Judge, Excise, Khagaria in connection with Alauli P.S.
