====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2022 and is a person with clean antecedent.

The informant alleges that he was returning after withdrawing an amount of Rs. 2,15,000/- from SBI and when he was about to reach the CSP Centre, he was accosted by two motorcycle borne criminals who stopped him and fled with the bags containing money.

Learned counsel for the petitioner submits that

No.8003 of 2023(2) dt.29-04-2023 2/2 petitioner was not arrested from the spot, as such, nothing was recovered from his conscious possession, it is next submitted that name of the petitioner transpired in the case based on confessional statement of co-accused Rajesh Kumar Yadav which has no evidentiary value.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Falka (Pothia) P.S. Case No. 310 of 2022.

One of the bailors of the petitioner shall be his father Bhim Mandal.
