JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section394 of the Indian Penal Code. Petitioner and some others are said to have made attempt to snatch the motorcycle of the informant but he was caught on the spot.

Submission on behalf of the petitioner is that the entire prosecution case is false and concocted and as a matter of fact, some hot exchange of words had taken place between the petitioner and the informant but the informant, taking the local police in collusion, got arrested the petitioner and lodged this false case. It is further submitted that moreover, the seizure list does not

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mushahari P.S. Case No. 197 of 2015 to the satisfaction of learned Sub Judge-IIIrd-cum-learned Additional Chief Judicial Magistrate, Muzaffarpur.
