The petitioner seeks bail in connection with Gaighat P.S. Case No. 231 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that informant along with other Police personnel reached at village-Jarangdih to apprehend Sunil Singh (Petitioner) in connection with Laheriya Sarai P.S. Case No. 274 of 2019, where he was apprehended, at that time, they received information about keeping of liquor by him in his house. Thereafter, on search, 62 bottles each containing 180 ML and 26 bottles, each containing 375 ML Indian made foreign liquor recovered from the house of the

Learned counsel for the petitioner submits that while alleged bottles of liquor are said to be recovered at the time of apprehending of the petitioner on 23.07.2019 in connection with Laheriya Sarai P.S. Case No. 274 of 2019, but after releasing the petitioner in connection with Laheriya Sarai P.S. Case No. 274 of 2019, he surrendered in this case on 26.11.2019 and since then he is in custody.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Gaighat P.S.
