The petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 67 of 2018, registered for the offence punishable under Sections 363/366(A) of the Indian Penal Code.
The F.I.R. has been filed by the father of the victim girl on the allegation that the petitioner has kidnapped the victim girl.
The learned counsel for the petitioner submits that the petitioner is innocent and the statement of the victim girl made under Section 164 Cr.P.C. before the learned Magistrate would bear it out that the victim girl had voluntarily gone with the petitioner to Kolkata and thereafter, had returned
Patna High Court Cr.Misc. No.2599 of 2019(2) dt.21-01-2019 2/2 back. It is further submitted that in the said statement made by the victim girl, there is no allegation of kidnapping or committing any immoral act by the petitioner herein. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 25.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Sitamarhi in connection with Sonbarsa P.S. Case No. 67 of 2018.
