JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 08-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. At an earlier occasion, the petitioner had approached this Court directly in Criminal Misc. No. 49374 of 2014. On account thereof withdrew the aforesaid petition to come through proper channel.

Petitioner, who was a pillion rider, was apprehended along with Rakesh Kumar Raut on 10.03.2014 and further as they failed to show the documents relating to ownership of the motor cycle as well as on search from the possession of the petitioner one country made loaded pistol, mobile have been recovered. As such petitioner along with Rakesh Kumar Raut has

Patna High Court Cr.Misc. No.11015 of 2015 (2) dt.08-05-2015 been booked in this case.

Taking into account the period of custody since 11.03.2014 in consonance with the nature of allegation, petitioner Rishi Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Samastipur in connection with Samastipur Mufassil P.S. Case No. 97 of 2014, T.R. No. 2288 of 2015.
