1. Heard learned Senior Counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 306 of the Indian Penal Code.

3. Learned Senior Counsel for the petitioner submits that petitioner is a person with clean antecedent.

4. The informant alleges that his elder brother, sister-inlaw, two nephews and niece committed suicide and one nephew Golu's treatment was going on in the clinic of Dr. Bose. It is further alleged that as his brother was under pressure as he had incurred huge debt and under pressure of debt the family committed suicide. It is next alleged that even outsiders were also pressurizing him with regard to selling of land.

5. Learned Senior Counsel for the petitioner submits that

No.4905 of 2023(4) dt.27-07-2023 2/2 FIR was against unknown and from perusal of the allegation as alleged in the FIR, it would manifest that the informant has clearly stated that his brother had incurred huge debt on account of which he committed suicide along with his family members. It is further submitted that though it is alleged that some outsiders were also pressurizing him with regard to selling of land but then the outsiders including the petitioner had given loan to his brother and they were asking his brother to return the same but then they were not instrumental in the occurrence of suicide.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned Senior Counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Dehri (Nagar) P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
