In this case, the petitioner is seeking regular bail in connection with S.Tr. No. 688 of 2022 arising out of Dehri Nagar P.S. Case No. 720 of 2022, registered for the offences punishable under Sections 4/5 of Explosive Substances Act. As per allegation, five persons including the petitioner were arrested and from their Scorpio vehicle, 500kg of Ammonium Nitrate was recovered.

The learned senior counsel Sri Krishna Prasad Singh for the petitioner has submitted that the petitioner is under custody since 16.09.2022, whereas the maximum punishment for manufacturing or possessing the Ammonium Nitrate in

Patna High Court CR. MISC. No.5647 of 2023(2) dt.29-04-2023 2/2 contravention of Ammonium Nitrate Rules 2012, is three years. The petitioner is a person of clean antecedent. Learned counsel has cited Rule 9-B of the above-mentioned Rules. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 9th Addl. Sessions Judge, Rohtas at Sasaram in connection with S.Tr. No. 688 of 2022 arising out of Dehri Nagar P.S. Case No. 720 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
