JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-457, 380 of the Indian Penal Code.
Petitioners are neither named nor anything has been recovered from their conscious possession and it appears that except confessional statements as well as some criminal antecedent, there is nothing against them. Moreover, co-accused, Jeevan Sunar, having more or less similar allegation, has already been granted privilege of bail.

No.16725 of 2016 (3) dt.05-05-2016 2/2 Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bahera P.S. Case No. 540 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, District-Darbhanga subject to condition that one of the sureties must be local and holder of landed property.
