The petitioner is languishing in custody since 27.11.2014 in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code. On information that the miscreants are preparing to commit dacoity, raid was laid, when from the possession of the petitioner one country made musket, one country made pistol and 19 cartridges were recovered. A separate case was lodged under the Arms Act.
It is submitted by learned counsel for the petitioner that the investigation has already concluded and in the Arms Act case the petitioner has been granted bail.
Patna High Court Cr.Misc. No.14967 of 2015 (02) dt.08-05-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia in the district of Bhagalpur in connection with Gopalpur P.S. Case No. 304 of 2014.
Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
