JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Ladaniya P.S. Case No. 101 of 2018, registered for offences punishable under Sections 399, 401, 402, 413, 414, 120(B) of the Indian Penal Code and Section 498(A), 304(B), 506 and 34 of the Indian Penal Code.

Petitioner happens to be husband of the daughter of the informant and allegation against him is of causing her death for non fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that the daughter of the informant was suffering from illness and due to which, she died and information was also given to the informant and he has been in custody for more than five months. he has falsely been implicated in this case and has been in custody for four months.

Patna High Court CR. MISC. No.2807 of 2020(3) dt.25-02-2020 2/2 Learned counsel for the State has opposed the prayer for bail drawing attention of this court towards paragraph 1, 8 and 14, in which, there is allegation of torturing the daughter of the informant and later on her dead body was found. Having heard both sides, in view of the allegation, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail.
