JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.3.2015 in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that in the 164 Cr.P.C. statement the victim got her age recorded as 16 years when the court assessed her age as 17 years where she stated that since her mother assaulted her she went to her sister's house at Purnea but while returning from Purnea, at Kursela railway station she was arrested by the police.
