JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Asthawan P.S. Case No. 164 of 2015, registered under Section 302/34 of the Indian Penal Code.

The accusation is of killing of Babita Devi, daughter of the informant by her three brother-in-laws including the petitioner by pressing her neck as her husband used to reside outside and she was being abused usually.

Learned counsel for the petitioner submits that informant,who is the father of the deceased, is not an eye witness of the occurrence. Moreover, in course of investigation some witnesses have stated before the Police that the deceased had

Patna High Court Cr.Misc. No.13688 of 2016 (2) dt.22-04-2016 2/2 committed suicide by hanging herself. The Police has already submitted chargesheet under Section 306 of the Indian Penal Code. Further submission is that similarly situated co-accused Mahendra Ram has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 10.03.2016 passed in Criminal Misc. No. 11167 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 164 of 2015.
