Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

According to FIR, the petitioner allegedly gave a Chhura blow at the chest of Munna Kumar, as a result whereof, Munna Kumar died. Petitioner is in custody since 07.08.2017.

Earlier prayer for bail was refused on 02.01.2018 in Cr. Misc. No. 54175 of 2017 with liberty to renew the prayer after completion of 15 months of custody if the trial is not concluded in the meantime.

Submission is that the trial has not concluded

Patna High Court CR. MISC. No.4391 of 2019(8) dt.21-08-2019 2/2 as yet and the petitioner is ready to cooperate with the trial. Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Harsidhi Police Station Case No.161 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
