The petitioner seeks bail in a case under Section 302, 307, 379/34 of the Indian Penal Code.

There is very specific allegation against the petitioner that he along with Devi Rai, Jainuddin @ Vyas and Gopal Rai made indiscriminate firing at Jawahar Lal Singh and Jawahar Lal Singh died.

It is submitted that Devi Rai has already been enlarged on bail in the year 2007.

Jawahar Lal Rai got as many as seven fire arm injuries and there is very specific allegation against the petitioner that he also made indiscriminate firing.

Considering the facts aforesaid, I am not inclined to

Patna High Court Cr.Misc. No.23097 of 2015 (4) dt.29-09-2015 2/2 enlarge the petitioner on bail. Accordingly, the same is rejected. The trial court is directed to expedite the trial and hold the trial on day to day basis and conclude the same within nine months from the date receipt of this order since the petitioner is in custody since 01.11.2010.
