JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-304(B)/201 & 316/34 of the Indian Penal Code as also Sections-3/4 of Dowry Prohibition Act.

Petitioner No. 1 is brother-in-law of the deceased whereas; petitioner No. 2 is wife of petitioner No. 1. Submission on behalf of petitioners is that petitioners are residing in Nepal in connection with their livelihood and as a matter of fact, they do not have any concern with affairs of husband of the deceased.

The first information report reflects that it was husband

Patna High Court Cr.Misc. No.17575 of 2016 (2) dt.29-04-2016 2/2 of the deceased, who pressurized her to fetch dowry from her husband.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that investigation against petitioners, has already been completed, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Raxaul P.S. Case No. 169 of 2012 corresponding to Sessions Trial No. 2445 of 2015 to the satisfaction of Learned Additional Sessions Judge-III, Motihari, East Champaran.
