The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, all the FIR named accused persons including petitioners armed with weapons assaulted the son of informant on account of which he got severely injured. It is submitted that specific accusation of assault is against co-accused Bipin Kumar and Jhulan Yadav. So far as these petitioners are concerned, there is general and omnibus

Patna High Court CR. MISC. No.5934 of 2023(2) dt.10-04-2023 2/2 allegation. Both parties are close relatives. Informant and husband of petitioner no. 1 are step brother. The alleged occurrence took place due to land dispute. Petitioners are ladies and they claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Purnea in connection with Jankinagar P.S. Case No. 265 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
