JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Marauna P.S. Case No. 115 of 2019, registered for offences punishable under Sections 25(1-b) a/26 of the Arms Act. Allegation is of recovery of three country made pistol from the possession of the petitioner apart from that he is accused in one more case under Section 302 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that only empty country made pistols were recovered from the petitioner and he has been in custody since 25.09.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as well as criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the

Patna High Court CR. MISC. No.2640 of 2020(4) dt.27-02-2020 2/2 charge is framed, petitioner will be at liberty to renew his prayer for bail.
