Petitioner is not named in the first information report but in course of investigation when further statement of the informant was recorded, he expressed suspicion against the petitioner and almost similar statement was made by the witness.

No doubt, petitioner could be remanded in this case in the year 2015 but it would appear from perusal of the impugned order that the petitioner voluntarily surrendered before the court below. Considering the facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Brahmpur (Krishna Brahma) P.S. Case
