JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-02-2022 Heard Mr. Hridya Narayan Harshit, learned Advocate for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Marouna P. S. Case No. 42 of 2020, dated 02.04.2020, corresponding G.R. No. 571 of 2020, instituted for the offences under Sections 341, 323, 307, 354(B), 379, 504 and 34 of the Indian Penal Code. Though the petitioners are alleged to have taken part in the assault and committed misdemeanor against the
Patna High Court CR. MISC. No.15015 of 2021(2) dt.25-02-2022 2/3 wife and daughter of the informant, but the specific accusation is against Umesh Mahto and Parmeshwar Mahto. Parmeshwar Mahto is the husband of petitioner no. 3. So far as the accusation against the petitioners are concerned, it is general and omnibus.
The petitioners and the informant and his associates come from the same stock of family and because of land dispute between them, a clash had taken place in which most of the members of each of the family were made accused.
In the present case, the main accusation is against Parmeshwar Mahto and Umesh Mahto who are not the petitioners before this Court.
Considering the afore-noted facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.15015 of 2021(2) dt.25-02-2022 3/3 the learned A.C.J.M.-VI, Supaul, District - Supaul in connection with Marouna P. S. Case No. 42 of 2020, corresponding G.R. No. 571 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
