The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per allegations in the FIR, the nine accused persons on three motorcycles are stated to have looted the informant and his friends of their belongings, details of which have been given in the FIR.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. Referring to the order of the learned trial Court rejecting the application for bail of the petitioner it is submitted that the name of the petitioner transpired in course of investigation in the confessional

Patna High Court CR. MISC. No.16999 of 2021(2) dt.26-08-2021 2/2 statement of co-accused Umesh Yadav made before the police. Another co-accused Sonu Yadav whose name also transpired in the confessional statement of the aforesaid Umesh Yadav has been enlarged on bail vide order dated 27.7.2021 passed in Cr. Misc. No. 14722 of 2021. The petitioner has been falsely implicated in the case because of his antecedent. He is in custody since 6.12.2020 and investigation in the case has concluded without putting him on T.I. parade. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, the petitioner is directed to be enlarged on bail in connection with Udwant Nagar P.S. Case no. 233/2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
