The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 149, 341, 323, 302, 504, 506 of the Indian Penal Code.
As per prosecution case, the petitioner and others are alleged to have concertedly assaulted the informant's son with intention to commit murder. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and
Patna High Court CR. MISC. No.4761 of 2023(3) dt.20-06-2023 2/2 omnibus allegation against the petitioner. There is no specific accustion against the petitioner. The petitioner was not apprehended from the spot. There is land dispute between the parties. The petitioner is languishing in custody since 04.05.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Gaya in connection with Chakand P.S.
