JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This is an application for grant of anticipatory bail in connection with Shankarpur P.S. Case No. 107 of 2018, disclosing offences under Sections 452, 147, 148, 149, 341, 342, 323, 324, 307, 380, 504, 506, 385, 354 of the Indian Penal Code.

Allegation against petitioner no.1 is of firing that does not hit anybody and allegation against petitioner no.3 is of assault to the brother of the informant by Dabiya causing injury in his finger and petitioner nos.2 & 4 are also named in the F.I.R. and there is also allegation of demand of Rangdari and theft of several articles.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.6860 of 2019(3) dt.03-04-2019 2/2 that the dispute arose with respect to construction of boundary wall near the land of the school and for that earlier the relative of the petitioners has filed a case against the informant and others and even according to the F.I.R., no firearm injury has been received to anybody and other injury is not on the vital part of the body.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Madhepura, in connection with Shankarpur P.S. Case No. 107 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
