2. The petitioner apprehends his arrest in connection with Harnaut P.S. Case No. 413 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 117(2), 324(4), 303(2), 109(1), 351(3), 352, 3(5) of the BNS and 27 of the Arms Act.

3. As per allegation, all the accused persons stopped the car of the informant and started abusing him and his wife and attacked on the informant and injured him but he was saved. It is further alleged that one co-accused, fired upon the informant and

Patna High Court CR. MISC. No.10327 of 2025(3) dt.17-09-2025 2/3 some accused persons snatched mangalsutra and golden chain from informant's wife. It is also alleged that one co-accused assaulted the informant with iron rod and petitioner started throwing stone on the car of the informant.

The learned counsel for the petitioner has submitted that there is no allegation of assault attributed against this petitioner rather the allegation of assault has been attributed against the coaccused persons. He further submits that the allegation of firing is also not against this petitioner rather the allegation of firing is against Ritik Raushan who has been declared Juvenile. The allegation against the petitioner is that he has pelted stones on Scorpio Vehicle of the informant. Learned counsel has further submitted that the Scorpio vehicle does not belong to the informant and in this regard, he has filed a supplementary affidavit.

5. Learned counsel for the informant has submitted that the petitioner has three criminal antecedents and he has damaged his Scorpio vehicle, to which the learned counsel for the petitioner replied that in those cases the petitioner has been granted bail.

6. The allegation of assaulting the informant and of firing is against other co-accused persons and the only allegation against this petitioner is that the has pelted stones on the Scorpio vehicle of the informant.

7. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or

No.10327 of 2025(3) dt.17-09-2025 3/3 surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Nalanda, Biharsharif in connection with Harnaut P.S. Case No. 413 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
