JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 304B of the Indian Penal Code. Petitioner happens to be husband of the deceased, who died in other than normal circumstances within seven years of her marriage. The post mortem report of the deceased discloses that altogether seven injuries were found on the person of the deceased. Moreover, prior to her death, a case under Section 498A of the Indian Penal Code had been lodged against the petitioner by the informant.
Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for
Patna High Court Cr.Misc. No.14940 of 2016 (2) dt.11-04-2016 2/2 bail in connection with Sessions Trial No. 355 of 2015 arising out of Sakari P.S. Case No. 75 of 2015 pending in the court of Additional Sessions Judge-II, Madhubani stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
