1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Kahalgaon P.S. Case no.631 of 2023 registered under sections 304B and 34 of the Indian Penal Code.
3. As per the prosecution case, sister of the informant was married to the petitioner about one year ago. It is stated that the accused persons including the petitioner herein started to torture the informant's sister. The informant was finally informed that his sister had hung herself to death. On reaching the place of occurrence, the informant saw that she had been strangulated.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the
Patna High Court CR. MISC. No.6841 of 2024(4) dt.26-04-2024 2/2 reason that he happens to be the husband of the deceased. The allegations are false and concocted. There are no eye witness to the occurrence. The deceased was a short tempered lady who died as a result of hanging over a trivial family dispute and the same is supported from the contents of the post-mortem report (Annexure-P/2). Several co-accused have been enlarged on bail. The petitioner is in custody since 9.6.2023 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner who happens to be the husband of the deceased together with the material that has transpired in course of investigation, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
