JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Tribeniganj P.S. Case No. 414/2017, registered for offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the father of the informant by means of spade, while he was asking him to surrender before the court below in connection with other case. Thereafter, the father of the informant was taken to hospital for his treatment in course of treatment, he died. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the injury was caused to the deceased by hard and blunt substance. Further submission is that he has been in custody for six months. Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.2894 of 2020(4) dt.27-02-2020 2/2 bail and submitted that there is allegation against him of assaulting the father of informant by means of spade and the petitioner also carries criminal antecedents. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
