The petitioner seeks bail in a case under section 302, 201/34 of the Indian Penal Code which has been registered against unknown.

It is alleged that Munni Devi, widow of the deceased identified the dead body of Surendra Yadav @ Bhagatjee. It has come that one Jawed developed illicit relationship with the wife of the deceased Surendra Yadav. It has come that Jawed took certain amount from the wife of Surendra Yadav and that is why Jawed with his associates killed Surendra Yadav. During the course of investigation one Abhay Singh @ Fantush in his confessional statement accepted the manner of

Patna High Court Cr.Misc. No.23643 of 2015 (2) dt.09-07-2015 occurrence. Except the confession, the I.O. did not collect any tangible material against the petitioner.

Considering the facts aforesaid and that coaccused Dhakaniya Chaudhary has been enlarged on bail by this Court by order dated 25.06.2015 vide Criminal Misc. No. 19986 of 2015, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Both Gaya P.S. Case No. 252 of 2014.
