Petitioner was neither caught on the spot nor his name surfaced in the statement of co-accused Golu Mishra when he was caught on the spot but subsequently, confessional statement of coaccused Golu Mishra was recorded and in the aforesaid confessional statement, co-accused Golu Mishra stated that arms and ammunitions had been provided by the petitioner and except the aforesaid material, there appears to be nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Town P.S.
