In this case, the petitioner is seeking regular bail in connection with Siwaipatti P.S. Case No. 07 of 2022, registered for the offences punishable under Sections 386 of the IPC. As per allegation, ransom was demanded from the informant by co-accused Pappu Pathak.

The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. One co-accused Abhishek Kumar was arrested and he has stated that he, along with his associates, was demanding the ransom. He has submitted further that there is no material against the petitioner at all in the entire case diary. He has also submitted that in all the three cases, as mentioned in the paragraph no. 3 of the bail petition, the petitioner has been granted bail. He is under custody since 04.06.2022.

No.5946 of 2023(2) dt.05-05-2023 2/2 Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (East), Muzaffarpur in connection with Siwaipatti P.S. Case No. 07 of 2022 , subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.

(iii) The petitioner shall remain present physically on each and every date till framing of the charges. In case of failure on two consecutive dates without any valid reason, the learned court below will be at liberty to cancel the bail bond of the petitioner.
