2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 467, 468, 471, 419, 420 of the Indian Penal Code.

3. As per prosecution case, it is a case of cheating in respect of execution of sale deed in favour of co-accused persons by the mother of the informant. The petitioner is said to be witness in the sale deed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is not purchaser rather he is only witness of the sale deed. He has no concern with the co-accused persons who have purchased the

Patna High Court CR. MISC. No.7447 of 2024(2) dt.17-02-2024 2/2 land of informant's mother. It is further submitted that it is a case of civil in nature. Moreover, he is languishing in judicial custody since 7.11.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sheikhpura P.S. Case No. 736 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura.
