JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 13.03.2015 in connection with Runnisaidpur P.S. Case No. 105 of 2014 for the offences instituted under Section 304(B)/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.
The accusation is of killing the daughter of the informant after one year of marriage for non-fulfilment of dowry demand.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.03.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused due to mistake of fact.
Patna High Court Cr.Misc. No.23581 of 2015 (3) dt.12-08-2015 2/2 On behalf of the State it has been submitted that the petitioner is the husband of the deceased and there is direct allegation against him.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Runnisaidpur P.S. Case No. 105/2014, pending in the court of the learned C.J.M., Sitamarhi. Anyhow, the trial court is directed to take all necessary steps to expedite the trial of the present case and conclude the same preferably within a period of one year from the date of receipt/production of copy of this order.
