It appears that by order dated 10.08.2022 passed in
Patna High Court CR. MISC. No.4996 of 2022(2) dt.24-08-2022 2/3 Cr.Misc. No. 2357 of 2022 the anticipatory bail petition as against petitioner nos. 1 and 3 stands dismissed as withdrawn.
Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 147, 149, 341, 342, 323, 353, 332, 337, 379, 411, 283 and 427 of the Indian Penal Code and Section 3/4 of the Prevention of damage to Public Property Act, 1984, registered in connection with Tariyani P.S.Case No. 162 of 2021.
As per allegation, when the police were checking the vehicles, the accused persons named in the FIR protested against the police party and created hindrance in their discharge of official duty. They also assaulted the police personnel. The learned counsel for the petitioners has submitted that petitioners are the persons of clean antecedents. They were not present at the spot.
Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten
Patna High Court CR. MISC. No.4996 of 2022(2) dt.24-08-2022 3/3 thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM 2nd, Sheohar in connection with Tariyani P.S.Case No. 162 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
