JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-414/34 of the Indian Penal Code.

According to prosecution case itself, petitioner was neither caught at the spot nor anything was recovered from his conscious possession and it were co-accused who disclosed that the petitioner used to purchase stolen motorcycles. No doubt, petitioner carries criminal antecedent of seven cases but submission on behalf of the petitioner is that all the above-said 7 cases were registered in the year, 2010 and the registration of the aforesaid cases is nothing but only high handedness of the police.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.16780 of 2016 (2) dt.27-04-2016 2/2 of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mujahidpur (Babarganj) P.S. Case No. 138 of 2010 to the satisfaction of Smt. Sulekha Jha, learned Judicial Magistrate-Ist Class, Bhagalpur.
