The petitioners seek regular bail in connection with Goraul P.S. Case No. 306 of 2022 registered for the offence under Sections 363, 366(A)/34 of the Indian Penal Code. The prosecution case, in brief, is that on 27.7.2022 when daughter of the informant, aged about 15 years, went to attend her coaching class at Bakshama but she did not return. The informant started searching her then she came to know that the accused persons including the petitioner kidnapped her daughter.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.8532 of 2023(2) dt.13-04-2023 2/3 petitioners are innocent and have committed no offence. These petitioners are family members of the main accused Shivchandra Sahni due to this reason they have falsely been implicated in this case. It is further submitted vide para 10 of the petition that the victim girl recovered and did not support the prosecution allegation in her statement recorded u/s 164 of Cr.P.C. She also stated that she solemnized marriage with the co-accused namely, Shivchandra Sahni out of her own sweet will. Similarly situated co-accused persons have already been granted bail by learned Court below itself vide order dated 21.12.2022 passed in A.B.P. No. 3471 of 2022. It is further submitted that the petitioners are languishing in judicial custody since 23.7.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Goraul P.S. Case No. 306 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Sessions
